Safe Work Method Statements for High-Risk Construction Work in the Northern Territory

What it is

The Northern Territory requires a Safe Work Method Statement (SWMS) to be prepared before any high-risk construction work commences under regulation 299 of the Work Health and Safety (National Uniform Legislation) Regulations 2011 (NT). Regulation 291 defines the 18 categories aligned with the model WHS Regulation.

NT WorkSafe enforces the framework. The section 34B industrial manslaughter offence (from 2020) with life imprisonment maximum for individuals is distinctive in Australia and adds another layer of consequence for SWMS failures causing workplace deaths.

Categories align with model WHS

NT regulation 291 lists the same 18 categories as NSW, QLD, WA, SA, TAS and ACT under the model WHS framework. Work at heights above 2 metres, asbestos disturbance, confined space, deep excavation and 14 other categories.

When a SWMS is required

Regulation 299 requires the SWMS to be prepared BEFORE the high-risk construction work commences.

SWMS content, review and principal contractor duties

Regulation 299 requires identification of the type of work, hazards, controls and implementation. Regulation 300 requires review on method change, control inadequacy or notifiable incident. Regulation 309 requires the principal contractor to obtain SWMS from each contractor.

Reg 292 construction project trigger at $1 million

The WHS Regulations 2011 (NT) reg 292 sets the construction project value trigger at $1 million, amended on 28 May 2026 by SL No. 14 of 2026 (up from $500,000). That is the highest construction project value threshold in Australia.

Above the $1 million threshold, principal contractor duties attach including reg 309 SWMS aggregation. Below the threshold, individual PCBUs manage their own SWMS obligations without an over-arching principal contractor coordinator.

The NT WorkSafe bulletin still cites the previous $500,000 figure and is stale on the current $1 million threshold. TradeForm NT templates use the correct $1 million figure post-28 May 2026.

Penalties

Regulation 299 offence carries penalties in line with the model WHS Regulation.

Interaction with section 34B industrial manslaughter

SWMS failures that cause a workplace death can be prosecuted under section 34B industrial manslaughter (from 2020). The NT's life imprisonment maximum for individuals is unique in Australia and reflects the seriousness with which NT courts have historically treated construction industry deaths.

Interaction with Building Practitioners Board

WHS Act SWMS breaches by an NT registered building practitioner can trigger Building Practitioners Board disciplinary action. The Commissioner for Residential Building Disputes has separate jurisdiction over building work disputes but coordinates with NT WorkSafe on safety-related workmanship failures.

Cost plus prohibition context

The Building Regulations 1993 (NT) prohibit cost plus contracts by requiring every prescribed residential building contract to specify a total contract price. Fixed pricing improves SWMS compliance predictability because scope and cost are known before work starts.
