Crystalline Silica Control Requirements in Northern Territory Construction

WHS Regulations 2011 (NT) crystalline silica reforms from 1 September 2024. Silica risk control plan, air and health monitoring for high-risk processes.

What it is

The Northern Territory adopted the national crystalline silica regulatory reforms through amendments to the Work Health and Safety (National Uniform Legislation) Regulations 2011 (NT) commencing 1 September 2024. NT WorkSafe enforces the framework.

The framework

Regulations 529CA to 529CD of the WHS Regulations 2011 (NT) set the crystalline silica control requirements. High-risk processes include cutting, grinding, drilling, sanding or polishing crystalline silica substances containing more than 1 per cent crystalline silica.

Silica risk control plan

A PCBU must prepare a written silica risk control plan for any high-risk crystalline silica process.

Air and health monitoring

Air monitoring where exposure cannot be verified below 0.05 mg/m3. Health monitoring for exposed workers.

Engineered stone ban

The 1 July 2024 national engineered stone ban applies in the Northern Territory.

Interaction with section 34B industrial manslaughter (2020)

Silica-related deaths caused by PCBU or senior officer conduct can be prosecuted under section 34B industrial manslaughter (from 2020). The NT's life imprisonment maximum for individuals under section 34B is unique in Australia.

Reg 292 $1 million construction project trigger

The NT reg 292 construction project trigger sits at $1 million (from 28 May 2026), the highest in Australia. Above the threshold, principal contractor duties attach including SWMS aggregation and silica framework coordination.

Interaction with Building Practitioners Board

Silica framework breaches by an NT registered building practitioner can trigger Building Practitioners Board disciplinary action alongside NT WorkSafe enforcement.

How the Northern Territory compares

NT's 1 September 2024 reforms align with the national timeline. Regulation numbering matches NSW, QLD, WA, SA, TAS and ACT.

The NT life imprisonment maximum for industrial manslaughter combined with the silica framework creates the highest theoretical individual penalty exposure in Australia for silica-related deaths.
